NOTICE. PLEASE READ THESE TERMS & CONDITIONS CAREFULLY. BY ACCESSING THIS WEB-SITE AND/OR PLACING AN ORDER WITH PRIMESOURCE GRAPHICS YOU AGREE TO BE BOUND BY THE TERMS & CONDITIONS STATED BELOW. IF YOU DO NOT AGREE TO THE TERMS & CONDITIONS STATED BELOW, PLEASE DO NOT ACCESS THIS WEB-SITE. PRIMESOURCE GRAPHICS, INC. RESERVES THE RIGHT TO CHANGE, MODIFY OR AMEND THESE TERMS AND CONDITIONS WITHOUT ANY NOTICE.

LIMITATION OF LIABILITY

In no event shall PrimeSource Graphics, Inc. or its licensors, suppliers, or vendors, their officers, directors, employees, or agents, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data or profits, whether or not PrimeSource Graphics, Inc. has been advised of possibility of the damage, arising out of or in connection with the use or performance of the site or of failure to provide services that you order from PrimeSource Graphics, Inc. or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall PrimeSource Graphics, Inc. be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of the site or its content.

Our office hours are 8:30 AM to 5:00 PM EST Monday - Friday.

TURNAROUNDS

Jobs for parts that are in stock will typically be shipped within approximately 2 business days. Problem jobs or jobs that contain custom art and/or require proofs will take longer. In addition, large orders may require additional processing time. Typical turnaround timeframe for custom printed digital jobs is 3-5 days from proof approval and 7-10 days from proof approval for screen jobs.
Various other factors such as equipment failures, technical difficulties, large production days, or anything else outlined under the "ORDER SHIPPING AND DELIVERY" section of this document may impede on our turnaround time.

RETURNS / REFUNDS

Since all orders are unique to the customer, All Sales Are Final. If we verify that we made an error, we will re-print the order. No Refunds or Credit.

Customer must notify PrimeSource Graphics, Inc. within 6 business days of order acceptance to notify any defects discovered in the ordered product or the claim will be denied. In order to receive replacement Customer must return 100% of the received product within 15 days (on their own expense) from the time when the ordered product delivery was taken.
We will only take products back if there are defects or if specifications are not met as long as they are specifications that we have agreed to do on the graphic. Any specifications you place during the order will appear on your invoice. These specifications are used as a reference and NOT a sales order.
PrimeSource Graphics will not assume that a product is printed incorrectly based solely on a customer's word. PrimeSource Graphics needs to receive back the product so we can examine and make our own assessment of the cause of the print error. This is to increase our quality and to best serve our customers.

PRICING ERRORS

PrimeSource Graphics does all it can to ensure that prices and other information supplied on our website is correct. However, in the case of incorrect published pricing or calculatlion errors, PrimeSource Graphics reserves the right to provide customer with revised pricing prior to printing the job. In this situation, customer has the right to cancel order if they do not wish to move forward at revised pricing and they will be refunded the full purchase price.

MINIMUM ORDER

All orders are subject to PrimeSoure Graphics minimum order policy that total order must exceed $100. Also, individual part quantities and/or combined total order quantities must be high enough that it is cost effective to run the job as determined by PrimeSource Graphics. If order quantities are too small customer will be notified in advance of printing the job. PrimeSource reserves the right to cancel the order and refund the customer's purchase price. We will work with customers as best as possible to provide available options including ordering additional parts and/or quantities that will make the job more feasible.

CUSTOMER CONTENT

You understand that all information, data, text, photographs, graphics, messages or other materials ("Content") are the sole responsibility of the person from which such Content originated. This means that you, and not PrimeSource Graphics, Inc., are entirely responsible for all Content that you use from PrimeSource Graphics, Inc. or send, upload, post or transmit via the Service. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. You agree to not use the Service to send, upload, post or otherwise transmit any Content that contains (i) child pornography or anything indecent, homosexual, obscene, lewd, lascivious, filthy or vile; (ii) a threat to kidnap or injure a person, a threat to injure the personal property or reputation of another person, a threat to accuse any person of a crime, a threat to inform another that a person has violated any law of the United States, or a threat of blackmail/extortion; (iii) any matter advocating or urging the violation of liberties granted to living beings by their creator; (iv) any defamatory remarks directed any individual person; or (v) any content that infringes the intellectual property rights or other proprietary rights of PrimeSource Graphics, Inc. or any third party does not control posted by Customers and does not guarantee the accuracy, integrity or quality of the Content Under no circumstances will PrimeSource Graphics, Inc. be liable to you in any way for any Content you may be exposed to that you may find offensive, indecent or objectionable. Products and services are provided for your personal use only. You agree to abide by these terms of service and not to use these products and services or related messages for any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.

You acknowledge that PrimeSource Graphics Inc. does not pre-screen Content, but that PrimeSource Graphics, Inc. and its affiliates shall have the right (but not the obligation) in their sole discretion to remove any Content that violates the terms of service or may otherwise be objectionable. You further acknowledge and agree that PrimeSource Graphics, Inc. may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that the Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of PrimeSource Graphics, Inc., its users and the public.
In addition, PrimeSource Graphics, Inc does not ask for verification of the products or services you are requesting in regard to your official affiliation with the organization you are claiming to represent. We will process your order, however PrimeSource Graphics, Inc. will not be held liable for any and everything that happens in regards to fraudulent use of products purchased.

GOVERNING LAW

PrimeSource Graphics, Inc. is based in Longboat Key, Florida and all transactions take place on PrimeSource Graphics, Inc.'s. Any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted in Longboat Key, FL. You agree to submit to the jurisdiction of the city of Longboat Key, the county of Manatee, the state of Florida and the United States of America, their courts and agree that venue in these courts is proper in any such legal action or proceeding.

INDEMNITY

You agree that you shall indemnify and defend PrimeSource Graphics, Inc. and all parties from whom PrimeSource Graphics, Inc. has licensed portions of Content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms of Use or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into Products.

ORDER APPROVAL

Customer is fully responsible for final proof and layout approval prior to the printing process.

PrimeSource Graphics, Inc. is NOT LIABLE for errors in a final product caused by any of the following reasons:
Misspelling, Graphics, Bleeds, Grammar, Damage Fonts, Punctuation, Wrong cuts, Incorrect or Missing Folds, Die Lines, Crop Marks, Transparency, Overprint, Finished Product Size. In some situations we may tweak customer files if we feel it is desired or needed to produce the job. Any changes will be presented in the proof for customer’s approval. Minimum charge for typesetting and design is $45.00.

CUSTOMER SUBMITTED ARTWORK OR GRAPHICS

All artwork or designs and images should be provided in CMYK format. PrimeSource Graphics, Inc. is not responsible for any color shift that occurs in conversions from RGB to CMYK or PMS Pantone colors to CMYK color modes.

All artwork, designs and images must be provided in minimum of 150 DPI and CMYK/RGB color mode. PrimeSource Graphics, Inc. is not responsible for images printed as fuzzy, distorted or pixilated due to customer provided artwork.
PrimeSource Graphics will do everything in their power to make sure the prints come out as good as they can.

COLOR PROOFING & MATCHING

PrimeSource Graphics, Inc. is not liable for color matching or ink density on screen proofs approved by the customers. Screen proofs will predict design layout, text accuracy, image proportion and placement, but not color or density.

Application of UV Coating may effect or change the appearance of the printed colors. PrimeSource Graphics, Inc. is not liable for the final color appearance of a UV product.
PMS color matching is available upon request for no additional charge to your order. If there sis a color you need completely matched, we will need to be contacted in order to to the PMS matching. We will not match any other color charts (paint charts, 3M vinyl charts, etc)

ORDER CANCELLATION

PrimeSource Graphics, Inc. will be happy to help you cancel your order prior to printing. All notices of cancellations must be submited in writing (email is acceptable). However, orders may be subject to cancellation charges, including but not limited to charges associated to cancelling or returning the material to the supplier. Our Customer Service Team will inform you of any cancellation charges depending on the stage of the order.

Absolutely no refunds will be issued once an order has been plated, art output, or any process thereafter, including but not limited to Printing, Coating, and / or Finishing.
Once the order has been placed successfully, no refunds are issued for Graphic design services. PrimeSource Graphics is not responsible for any duplicated orders that are placed on our web site due to the customer mistake.

RUSH PROCESSING

Rush processing may be available upon request. Additional fees may apply to a rush processing job. The fees and the ability to produce a rush job will depend on numerous things, including: setup time; the time of day you are placing the order; the size (sq feet) or the order, and the other orders we are producing that day.
If you want to rush process an order you must do so when you place the order by specifying in the online order or by calling 1-404-699-5899.

RE-ORDERS

The online system does not keep history for previously placed orders. To re-order you must re-enter order details. In most cases we will retain art files and you do not need to re- upload art; however, you will need to reference the associated art file name(s). We will call you if we need art to be resubmitted. If you have any questions please contact our customer service department.

ORDER SHIPPING AND DELIVERY

PrimeSource Graphics, Inc. will always act to make sure that any production difficulties do not delay delivery schedules. In no case shall PrimeSource Graphics, Inc. be liable for any consequential or damages resulting from any delay in shipment or delivery.

All PrimeSource Graphics, Inc. customers agree not to hold PrimeSource Graphics, Inc. liable for delays in shipments caused by weather conditions, shipping company delays, international customs issues or any other circumstances beyond PrimeSource Graphics, Inc.'s direct control. PrimeSource Graphics, Inc. shipment and delivery dates are calculated based upon estimates provided by our suppliers.

PrimeSource Graphics, Inc. will always act to make sure that delivery schedules are met. However, unexpected equipment failure, malfunction and or technical problems may delay the printing process. In case of delay caused by technical difficulty, rush charges/fees will be refunded or waived where applicable. However, technical difficulty will not be the grounds for order cancellation or a refund.
PrimeSource Graphics, Inc. will not be held liable for any and all “Acts of God” which may impede on our ability to process and ship your order. Acts of God includes anything that is out of human control or prevention. This includes, but is not limited to, flooding, earthquakes, impromptu end of life for PrimeSource Graphics management, epidemics, plagues, tornados, hurricanes, rapid climate shift, fire, lightning strikes, or a change in the earth’s gravitational pull.
In addition, PrimeSource Graphics, Inc. will not be held responsible for any and all “Acts of Society” which may impede on our ability to process and ship your order. Acts of Society includes anything that is created by other humans that is beyond our control (of both the labor and management) and will hinder our work process. This includes, but is not limited to, acts of war, foreign invasion, acts of terrorism, heinous criminal acts (such as arson or murder), sabotage on our equipment, computers, or vehicles, bio terrorism/anthrax, labor strikes, management lockouts, being denied physical entrance to our work place by any means (a riot, mob, motor vehicle has crashed into our building, the building is surrounded by a blockade, etc), or any changes in the local, state, federal, or global political spectrum and all legislative, executive, or judicial law enacted by these bodies that may affect our work.

PrimeSource Graphics, Inc. can only use its own shipping account and will not use customer provided account numbers for any couriers. Orders must be shipped at whole quantities and may not be split up unless previously agreed to.

PAYMENT AND PROCESSING

PrimeSource Graphics will not process any order until we have received payment for it. That means that your credit card is charged when you place your order with us, not when it ships. Please understand if there are any other charges we will contact you to charge your card again either over the phone or online. We do NOT keep your credit information on hand for any reason, once it is charged it goes through our credit card processor. We keep the last 4 digits only so that you can reference the credit card you used to make your purchase.
If you choose to pay via check or money order, we will wait till the check or money order clears before we process and ship your order. Until then it will remain in our system on hold.

SHIPPING ERRORS & LOST PACKAGES

Lost or damaged claims can only be filed for shipments over $50.00 in value and can only be done after 30 days from package shipment. PrimeSource Graphics, Inc. is not responsible for 3rd party shipping errors, omissions or damaged shipments.

CUSTOMER SUPPLIED INCORRECT ADDRESS

When a package is not delivered due to an error made by the customer in submitting the proper shipping address, PrimeSource Graphics, Inc. will reship the package with corrected address and charge an additional shipping fee for the shipment.

TECHNICAL DIFFICULTIES

In the event of technical difficulties pertaining to Prime Source Graphics, we can not be held liable for any technical difficulties that are the result of error on part of the hosting company, the upstream provider or the end user. For example, issues or mistakes with the hosting account software or hardware issues can be faulted to Printer Presence. End user issues including operating system faults, virus or spyware problems, browser incompatibilities are not the responsibility or problem of PrimeSource Graphics, Inc. We recommend that you keep all of your software and virus definitions up to date to successfully avoid any issues.

REFUSAL OF SERVICE

We reserve the right to refuse service without disclosing a reason.
